CE vs FDA for Oral Care Products: What Export Buyers Need to Know

If you are importing oral care products into Europe or North America, understanding the difference between CE marking and FDA registration is not optional — it is a legal requirement. Confusing the two can lead to customs holds, rejected shipments, and costly compliance gaps. Here is what every export buyer needs to know.

CE Marking: The European Standard

CE marking indicates that a product complies with European Union health, safety, and environmental regulations. For oral care products classified as Class I medical devices, the manufacturer must compile a technical file, conduct a risk assessment under EN ISO 14971, and issue a Declaration of Conformity. A CE mark allows free movement across all 27 EU member states plus EEA countries. If you plan to sell in Germany, France, the Netherlands, or any EU market, CE marking is mandatory.

FDA Registration: The U.S. Requirement

The U.S. Food and Drug Administration (FDA) requires oral care products such as toothbrushes and dental floss to be registered under the establishment registration and device listing program. While premarket notification (510(k)) is not always required for manual toothbrushes, the manufacturer must still comply with Quality System Regulations (21 CFR Part 820) and label products accurately. FDA registration must be renewed annually between October 1 and December 31.

Which Markets Need Which Certification?

The general rule is straightforward: CE for Europe, FDA for the United States. However, buyers should also consider regional nuances — Canada requires an MDL (Medical Device License) from Health Canada, Australia mandates TGA (Therapeutic Goods Administration) registration, and the UK now operates its own UKCA marking system post-Brexit. Always confirm the specific requirements of your target market before placing an order.

How to Verify Supplier Certification

Do not rely solely on a supplier’s word. Ask to see the actual certificates — CE Declarations of Conformity, FDA establishment registration numbers, and ISO 9001 certificates. Cross-check FDA registration numbers on the FDA’s public Establishment Registration database. For CE documentation, verify that the Notified Body (if applicable) is accredited and recognized within the EU’s NANDO database.

Beyond CE and FDA: BPA-Free and Heavy Metal Testing

Regardless of the market, modern buyers increasingly demand third-party lab testing for BPA-free verification and heavy metal analysis (lead, mercury, cadmium, and phthalates). These test reports not only protect end consumers but also strengthen your brand’s compliance narrative. Suppliers who invest in regular third-party testing demonstrate a commitment to quality that goes beyond the minimum legal requirements.
